Why it matters

Anyone who missed the old age window, from school-leavers who took a gap to graduates and working people switching careers, can now aim for a law degree. The petitioner asked the court to record that the decision is final because the cap has been reversed before.

The law course age limit is gone. The Bar Council of India (BCI), which regulates legal education and the legal profession, told the Supreme Court on Friday, 6 November 2026, that it has withdrawn the upper age limits for admission to both the three-year and the five-year law degrees, known as the LLB (Bachelor of Laws). Its General Council passed the resolution a day earlier, on 5 November, the BCI’s lawyer told the court, Bar and Bench reported.

A bench of Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and V. Mohana then closed the case that had challenged the law course age limit, holding that it no longer had anything left to decide, LiveLaw reported.

What the BCI told the Supreme Court about the law course age limit

Advocate Radhika Gautam, appearing for the BCI, said the age restriction had been withdrawn and that the resolution was passed only the previous day, which is why it had not been filed earlier, according to LiveLaw and Bar and Bench.

The resolution gives a reason for ending the LLB age limit. After its own review, the General Council agreed that an absolute maximum age had too little academic justification, LiveLaw reported. The council said the existing rules on educational qualifications, attendance, teaching hours, exams and professional training were enough to protect standards without shutting out eligible candidates only because of their age. The decision followed a reasoned order by Rajendra Menon, a former Chief Justice of the Delhi High Court and co-chairman of the BCI’s legal education committee, and a resolution of its standing committee on legal education.

The petitioner’s side wanted the end of the law course age limit made firm. Senior advocate Zoheb Hossain asked the bench to record the last lines of the resolution, which call the decision final, because the BCI had once before withdrawn the limit and then brought it back, Bar and Bench reported. The court took the BCI’s statement on record and closed the plea.

Who can now apply for LLB courses

The LLB age limit that drew most of the litigation applied to the five-year integrated LLB, the course students usually join after Class 12. Under Clause 28 of Schedule 3 of the BCI’s Rules of Legal Education, 2008, general-category candidates had to be under 20 years of age to get in, LiveLaw, Bar and Bench and the Economic Times reported.

The reports differ on the other parts of the law course age limit. Bar and Bench said the 2008 rules set 30 years as the upper limit for the three-year LLB, taken after a first degree, with a five-year relaxation for certain reserved categories. The Economic Times reported that the limits the Supreme Court stayed in March 2017 were 22 years for the five-year course and 45 years for the three-year course, and gave the relaxed limit for Scheduled Caste, Scheduled Tribe and backward-class candidates in the five-year course as 22 years. NewsPlainly has not been able to settle the difference from the reports read; what is clear from all three is that the BCI has now withdrawn the upper age limits for both courses.

The decision paves the way for aspirants of all ages, the Economic Times said. That includes school-leavers who take a few extra years before applying to a five-year course, and graduates or working people who decide later in life to study law. Admission still depends on the usual qualifications, entrance tests and the colleges’ own seats.

Why the LLB age limit was challenged

The petition, filed by Rishabh Duggal, argued that the age cap breached the right to equality, the freedom to choose a profession and the right to life and liberty under Articles 14, 19(1)(g) and 21 of the Constitution, LiveLaw reported. It pointed to the 1993 rule barring people over 45 from enrolling as advocates, which the Supreme Court struck down in the Indian Council of Legal Aid and Advice case, and argued that a cap on studying law was an even harsher restriction.

High Courts had split on the LLB age limit. The Punjab and Haryana and Bombay High Courts held the clause went beyond the Advocates Act, while the Madras High Court upheld the age limit, according to the petition as reported by LiveLaw. The petition said only the Supreme Court could end that uncertainty for students.

What is still open after the end of the LLB age limit is the paperwork. The reports read did not say when the BCI will formally amend its rules or notify colleges and universities, and they did not mention any change to entrance tests. More education and court news is on NewsPlainly’s India page.
