Why it matters

Azam Khan is one of the Samajwadi Party's best-known leaders, and Uttar Pradesh votes in 2027. The detention shows how bail in one case does not end custody when another agency acts in a separate case. His conviction in the PAN card case still stands, so he remains disqualified from contesting elections.

Samajwadi Party leader Azam Khan was detained by the Enforcement Directorate (ED) outside Rampur jail on Saturday, 31 October 2026, minutes after he walked out on bail, officials told the Press Trust of India (PTI) news agency and Hindustan Times. Two days earlier, the Allahabad High Court had suspended his sentence in the dual PAN card case and granted him bail.

The ED acted in a separate case: its probe under the Prevention of Money Laundering Act (PMLA) into the Maulana Mohammad Ali Jauhar Trust, Azam Khan and others. The agency alleges that public money was used to build Mohammad Ali Jauhar University in Rampur. Azam Khan, 78, a former Uttar Pradesh Cabinet minister, has not been convicted in this case.

Detained or arrested? What the ED has said about Azam Khan

On the record, it was a detention, with a formal arrest to follow. An official of the ED’s Lucknow zonal office told Hindustan Times: “We have apprehended Azam Khan. After following arrest procedures, we will arrest him and produce before Ghaziabad, PMLA court.” Officials told PTI he could be arrested under the PMLA soon, and that the ED would seek his remand, or custody for questioning, from a special court in Ghaziabad.

The Times of India, citing agency sources, reported that he had been arrested under an Enforcement Case Information Report (ECIR), the ED’s version of an FIR, registered in 2019. The ED’s published list of press releases, checked at about 8.20 pm IST, had nothing on the detention.

ED officials questioned him outside the jail before driving him away, the Times of India and Bhaskar English reported. His son, Abdullah Azam Khan, freed on bail in the same case, went home.

In the Times of India’s English rendering, Azam Khan said as he was taken away: “This is the punishment for being a Muslim. The mistake is that a Muslim built a university. That is our crime.”

Why High Court bail did not set Azam Khan free

Bail is granted case by case. The High Court’s order of 29 October covers only the dual PAN card case: it suspended the jail term there while his challenge is heard. It did not touch any other case, and could not stop another agency acting in a separate one.

To walk out, he needed release orders in every case. The jail had them in 50 cases for Azam Khan and 40 for his son, superintendent Rajesh Yadav told the Times of India.

The ED’s step is fresh custody in a different case, decided by a special PMLA court. The High Court’s bail still stands. If the ED formally arrests him, he would need bail from that court as well before he could leave custody.

Separately, Rampur police have sought a remand warrant against him in an FIR registered on 13 October 2026 on the ED’s information, the regional news network ETV Bharat reported. That hearing is due on Monday, 2 November.

What the Allahabad High Court order said

Justice Samit Gopal ruled on 29 October on the revision petitions of Azam Khan and his son: sentences suspended, bail granted, convictions not stayed, the Indian Express and LiveLaw reported.

According to the Indian Express, the bench noted that Azam Khan faced 92 criminal cases, with eight convictions and 81 pending. Citing “criminal antecedents”, it found no fit case to stay the conviction. It granted bail after noting time already served, including remission: 4 years, 1 month and 9 days for Azam Khan.

Because the conviction stands, both remain disqualified from contesting elections, the Times of India and the news agency Asian News International (ANI) reported.

The case began with a December 2019 FIR on a complaint by BJP leader Akash Saxena, now the Rampur MLA. He alleged that Abdullah held two PAN cards with different dates of birth and used one to meet the minimum age of 25 for the 2017 Assembly election, in conspiracy with his father.

A Rampur court convicted both on 17 November 2025 and gave them seven years each. In May 2026 a sessions court raised Azam Khan’s term to 10 years on the state’s appeal, ETV Bharat reported. Their lawyer, Shashwat Anand, told Bhaskar English the conviction was not backed by enough evidence and rested only on allegations.

The ED case against Azam Khan: what the agency alleges

On 28 October the ED’s Lucknow office provisionally attached the land and buildings of Mohammad Ali Jauhar University, putting the attached value at ₹426.46 crore and the market value at about ₹1,170 crore, its press release says. Provisional attachment freezes property while a case goes on; it is not a finding of guilt. Azam Khan founded and controls the trust that holds the campus, the ED says.

The probe began on 26 FIRs alleging that farmers’ land was forcibly taken for the university. The ED alleges that contractors on government jobs diverted funds and material to the campus, and says one firm’s managing director admitted that 30 to 40 per cent of its Public Works Department contracts, worth about ₹186 crore, went on material for the university.

The ₹426.46 crore is a subtraction. The ED puts the campus cost at ₹499.09 crore (₹494.46 crore of buildings, per a 2023 official valuation, plus ₹4.63 crore of land) and accepts ₹72.63 crore as legitimately funded. NewsPlainly checked the sums: they add up, and the gap is about 85% of the cost. Beyond his remark at the jail gate, his side’s reply to these specific claims was not in the reports read.

What the Samajwadi Party has said

The reports read for this article, checked by about 8.40 pm IST, carried no statement from the Samajwadi Party or its chief, Akhilesh Yadav, on Saturday’s detention.

Akhilesh Yadav met Azam Khan in Rampur jail on 22 October. Afterwards he said the family had “been subjected to fabricated cases” and accused the BJP of targeting him and the university, ANI reported. Uttar Pradesh votes for a new Assembly in 2027 (more on that race).

What happens next for Azam Khan

The ED says it will produce him before the special PMLA court in Ghaziabad and seek remand; the reports read gave no time. A Rampur court hears the police remand request on 2 November. The High Court has yet to rule on whether the PAN case conviction stands.
